ACLU Considering Lawsuit Against Border Patrol
The ACLU has taken a stand against the use of checkpoints away from the border, in what they are referring to as a “Constitution-Free Zone”.
This area—all of the U.S. that falls within 100 miles of our borders—allows activities which violate Fourth Amendment rights of citizens. Normally under the Fourth Amendment of the U.S. Constitution, the American people are not subject to random and arbitrary stops and searches.
The actions by the Border Patrol also violate the Washington State Constitution which prohibits stopping people without reasonable suspicion of a crime.
